Crime does not pay. Prosecutor seeks repayment of $84,000 from Casino robbers

PHILIPSBURG - The suspects W.R.H. (40) and R.G.H. (36) have to pay USD 42,302 each, or spent 246 days in jail in the event they do not pay, for illegally obtaining a profit of USD 84,603.59 after the robbery at Sonesta Great Bay Casino on September 18, 2015, the Public Prosecution Service stated in a bulletin on Wednesday.

“This was decided by the Court of First Instance on June 29. The Prosecutor submitted an order to recover proceeds of crime for this amount. The prosecution believes that suspects should not financially benefit from the robbery, after all "crime does not pay" and therefore requested that the robbers repay this amount. The hearing regarding this order took place on May 18.

“During the September 18, 2015 robbery USD 293,835.28 was stolen, but only USD 209,231.69 was retrieved. W.R.H. and R.G.H. were convicted for this robbery on March 16, 2015 to 5 and 4 years in jail respectively.

“Orders to recover proceeds of crime fit within the new police of the Prosecutor's Office. The Prosecutor's Office from now on will be submitting more of such orders.‎”

Plenary Session of Parliament about the current financial position of the Country for Thursday

PHILIPSBURG – The House of Parliament will sit in a plenary public session on June 30, 2016. The Minister of Finance will be present for the session.   

The plenary public meeting reconvenes on Thursday at 2.00 pm in the General Assembly Chamber of the House at Wilhelminastraat #1 in Philipsburg.  This session will be carried by Soualiga Newsday live video feed.

The agenda point is the current financial position of the Country. 

This plenary session of the House was requested by Members of Parliament (MPs)MP F.A. Meyers, MP T.E. Heyliger, MP T.E. Leonard, MP L.J. Richardson, MD, MP J.E. Leonard, MP V.H.C. de Weever and MP L.M. Marlin- Romeo.

Members of the public are invited to the House of Parliament to attend parliamentary deliberations.

Notary Meredith Boekhoudt chosen as Lecturer for “The Law Matters to You”

PHILIPSBURG—In preparation for the second lecture in the series: “The Law Matters To You” Civil Law Notary Mrs. Meredith M. Boekhoudt LL.M has been chosen by the Department of Communication (DCOMM) and University of St. Martin (USM) as the Keynote speaker.

The lectures in the series: “The Law Matters to You” are educational in nature and aimed at providing awareness of the law and legal information to the public of St. Maarten.

Meredith M. Boekhoudt LL.M. has been a civil law notary on Sint Maarten since 2006. At the time of her appointment as civil law notary, she had worked as a candidate-notary on Sint Maarten and before that in the Netherlands, each time for a period of four years.

As civil law notary, and previously as candidate-notary, she has assisted many persons with the drafting and execution of their last wills and testaments, and in general with any matters of estate planning.

Notary Meredith M. Boekhoudt holds a Master’s Degree in notarial law from the Leiden University in the Netherlands. She additionally obtained her certificate “professional education” provided by the “Stichting Beroepsopleiding Notariaat” in the Netherlands, and has followed several courses on the topic of family law with the emphasize on inheritance law. Only a few weeks ago she attended a four day course on the New Inheritance Law given by Prof. Dr. G. van der Burght.

She believes that providing information to the public by means of presentations on the topic of inheritance, and family law in general is very important, and she has therefore given different presentations over the years upon requests from amongst others service clubs, churches, and other associations.

Notary Meredith M. Boekhoudt is honored to have been chosen to be part of the lecture series “The Law Matters to You” on July 5, 2016. She will be speaking on the topic of wills, estate planning, and family law in general at the University of St. Martin in Room: 202 at 7:00 pm sharp.

MP Lake: Government needs to review the Hillside Policy and Residential Erfpacht Canon

PHILIPSBURG – Independent Member of Parliament (MP) Maurice Lake told the House of Parliament on Thursday that proper planning is needed to avoid disasters, and that a plan to process permits more efficiently is also needed.

 
“My main concern is that the Ministry of VROMI needs to review the Hillsides Policy. The Hillsides Policy is outdated, 20 years old. Within those 20 years a lot has changed on St. Maarten.  
 
“The Ministry for example, should review the clause that states that you can only build a certain percentage on a specific amount of square meters of land.  St. Maarten does not have an abundance of land, and we need to look at being realistic.

“We have to look at our situation and adapt accordingly, of course still taking into consideration the environment and the basis for the hillsides policy. By changing this policy and by being more realistic with the building code restrictions we could better serve the average St. Maartener and land owners. 

“Based thereon more government residential land could be given to empower the local St. Maartener's dream of fulfilling the construction of their own family home.  Presently, we zoned out some of the most buildable areas in our current hillside policy, and that should not be the intention of the Ministry.  
 
“I agree you can't build in the trenches, guts, which you can't build on top of certain hills and that you need an excavation permit, but we have to be realistic and look at our own situation and work with that, but at the same time taking the surrounding into consideration. 

“Government needs to assign certain land for agriculture purposes. We need to better assist our local farmers with applying for government land for agriculture purposes. The process is too long and frustrated and we need to pay attention to this.
 
“Right now, St. Maarten has to keep up with tourism trends where eco-tourism plays a very important role.  We should give land owners the opportunity to develop an eco-tourism park under certain conditions. There must be a sustainable balance which I can agree with.
 
“Another concern of mine is that the Ministry of VROMI needs to review the residential erfpacht canon which, in many cases, is too high for the average local person.  We need to live up to the purpose it was established for, which is to give out land to empower the local person, who otherwise would not be able to afford to buy private land, to build their home.  St. Maarteners pride is in their home. That’s why I would bring a request to Parliament to abolish the Property Tax law.

“In closing, the Ministry of VROMI needs to look into the billing and payments of the erfpacht canon. This needs to be improved and one person within the Ministry should be assigned to send out invoices, because we have a lot of money out there for e.g. water rights which Government is still not collecting in the lagoon and other areas.  The lagoon has to be regulated because it is getting smaller and smaller without enforcing the proper controls.

“Madame Chairlady through you to the Minister, I would like to advise him to sit with the Minister of Finance and also come up with a better payment plan for civil servants who owe outstanding long lease canon. I do believe they got to pay on time so they don't end up in these situations but you can't send a bill for them for four years outstanding and take it out of their salary at once, from which they already have their monthly payments to make. Communication is key between the Ministry of VROMI, Finance and the Receiver's Office.

Three parliamentary meetings scheduled for Thursday

PHILIPSBURG - Three meetings scheduled for the House of Parliament on Thursday June 23.  The first of these meetings is a Central Committee meeting, which is scheduled to begin at 9:30am.  Two of the meetings will be carried live via Soualiga Newsday video feed.

The agenda point is: Discussion on the final joint draft Kingdom Law Dispute Regulation (Geschillenregeling) from Aruba, Curaçao and Sint Maarten

The second of these meetings, is a close door Committee of Finance meeting scheduled at 11:00 am with the agenda point: Presentation of the draft Budget 2017 of the Council of Advice.

The third, Plenary Session scheduled for 14:00 hrs., with the agenda points:  

1.      Incoming documents; 

2.      Approval report on exchange of views with Mr. J. Romney on the Election Ordinance; 

3.      Advice regarding the installation and composition of a Committee of General Affairs;

4.      Ontwerp van Landsverordening tot wijziging van de Landsverordening ruimtelijke ontwikkelingsplan in verband met het herinvoeren van artikel 28a

The Minister of Housing, Spatial planning, Environment and Infrastructure Meyers will be present for agenda point 4 of this Plenary Session.

Marie Genevieve de Weever School Playground/Basketball Court inaugurated by Minister Jacobs

PHILIPSBURG - Minister of Education Culture Youth & Sports Silveria Jacobs was on hand at the Marie Genevieve de Weever School on Monday morning to witness the finalized works to the Playground / Basketball Court and addressed the students as well as management and staff. 

The Minister Jacobs officially thanked the young, local contractor Mr. Ricky van Putten of Designer's Choice NV for the work he had done in alleviating the challenge of gravels on the playground and creating a play space for the children, as well as sitting areas and going beyond his contract to assist the school. The rerouting of water underground that was falling in that area was also addressed.

The issue of gravels on the playground  was one of the serious challenges listed by teachers as hampering education at the school. Teachers and staff have seen an improvement in student behaviour and a calmer atmosphere since the gravels have been removed. The space now boasts an outdoor basketball court which the students can utilize to build their skills and play in a structured manner.

Mr. van Putten also supported the Island Hoops foundation which promotes "Shoot Hoops not Guns" and addressed the students on this topic and handed out t-shirts to the students. Minister of Sports Jacobs further reiterated that she hopes the students will make good use of the new amenities at their school while making sure that safety and good sportsmanship was part of their play and games. She reminded them that they had a responsibility to take good care of their school.

During the event teachers encouraged the Minister of Sports to take the first shot with the ball donated by Mr. van Putten which she obliged. Even though she missed the first shot, she was able to hit the second to the cheers of students and teachers alike. Minister Jacobs encouraged the students to continue to be engaged in positive activities which would help build strong character and a strong St. Maarten.

Inter-parliamentary Relations Committee meets on Tuesday about IPKO

PHILIPSBURG - Tuesday, June 21 will be the debriefing of the Inter-parliamentary Kingdom Consultation (IPKO) and the Tripartite of May 30- June 3, 2016 that was held in Netherlands.

This will be a Permanent Committee of Kingdom Affairs and Inter-parliamentary Relations meeting that will start at 10:00 am. This session will be carried by Soualiga Newsday live video feed.

Labor Inspection detects considerable amount of illegal employment on building site on Bonaire

BONAIRE (Caribbean Netherlands) - The Labor Inspection was rather shocked by the number of foreigners who perform illegal work on a large construction in Kralendijk. Late October 2015 the KPCN and the Labor Inspection performed an inspection here.

Reason for this action were several complaints about dismissal and illegal employment, which were filed with the SZW Unit’s Labor Affairs department. Therefore the action was aimed at observance of the Labour Law Foreigners [Wet arbeid vreemdelingen], while checking whether there was any illegal employment.

Employers of 23 of the 37 employed foreigners did not have a work permit or did not have the proper work permit. This means that 62% of the foreigners was working illegally on this construction.

In addition it was checked whether the employees were working safely.

Generally the work on the construction was performed safely, which is worth a compliment.

The Labour Inspection considers it important that there is a healthy labour market, which after all is in everyone’s interest. The Labour Inspection will therefore continue to work for a safe and healthy workplace. (RCN Caribbean Netherlands)
